TERMS & CONDITIONS
PRODUCTS The products that are on sale at Zahir store are those that appear on the web and there is a description attached. The pictures try to be as faithful to reality, but there could be slight differences of color between the picture and the product you receive, due to differences in configuration of computer screens. All the pictures are property of Zahir store. If you want to use any of our pictures in your blog or website, please, let us know and make sure to link our website or shop.
The CUSTOMER can place his/her order by the following means: Online, by following the procedure set out on the website email@example.com. To complete his/her order, the CUSTOMER must provide the personal data as requested. The placing of the order by the CUSTOMER implies full and complete acceptance of prices, descriptions of the items on sale and the Terms and Conditions of Sale, as well as any other terms specified in the order itself. Zahir Store shall inform the CUSTOMER, as soon as possible, of any unavailability of ordered items.
You accept that the products offered by Zahir Store in the online store are subject to stock limits. If any of the products are not available once you have placed the order, we will inform you as soon as possible. At that time, you can modify your order or cancel it.
PAYMENT All the payments will be done through PayPal, an online payment processor fully secure and trusted. To obtain more information about PayPal, please, go to www.paypal.com Once the payment is confirmed, we will send you the package.
PRICES The prices on our website are shown in Euros for all countries.
In accordance with the applicable legislation, any purchase made on our website is subject to the Value Added Tax (VAT). Prices will include the applicable tax at any given time. Depending on the country of destination of the shipment, a fixed cost will be added to each order for packaging and shipping. Such an additional cost will be shown on the website.
The price of the products will be as stipulated on our website at all times, except in the case of obvious error. Although we make every effort to ensure that all prices listed on the pages are correct, errors may occur. If we discover an error in the price of the products that you have ordered, we will inform you as soon as possible, giving you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, the order will be cancelled and any amounts paid will be reimbursed in full.
We are not obligated to provide you the product(s) at an incorrect lower price (even if we have sent you the Delivery Confirmation) if the error in the price is obvious and unmistakable and could reasonably be recognized by you as an incorrect price.
The shipping is made from Spain to the whole of Spain, Canary Islands and Baleares as well as to the countries belonging to the European Community.
Orders will be delivered to the delivery address that you provided on the form, so it is important that you pay special attention when completing the delivery address data. We will not be held liable if the delivery address is incorrect or incomplete.
For security reasons, Zahir Store will not send any order to post office boxes or military bases, nor will orders be accepted when it is impossible to identify the order recipient or their address.
Delivery costs: Delivery costs vary by destination. On the website will be indicated if there is additional charge for the shipping and will be clearly shown. These costs will be included in the summary at the end of the buying process.
Delivery problems: You must notify Zahir Store if you have not received your order after more than ten (10) working days.
If it is impossible for us to make the delivery, the courier service will contact you again to arrange a new delivery date.
When you receive your order, you must verify that everything is as requested. If there is any discrepancy or problem with the order, contact Zahir Store through the contact e-mail address and provide us with your personal details and the order number, indicating the discrepancy or problem. We will contact you as soon as possible to resolve the incident.
TRANSFER OF RISK AND OWNERSHIP
The user takes ownership of the Zahir Store products when you receive the shipping confirmation and the product leaves from our warehouses. Liability for the Zahir Store products is transferred to the user as soon as the order is delivered.
CUSTOMS AND IMPORT TAXES
Every country has their own import laws, you might be required to pay local duties and costumes taxes. Import taxes, customs and other related expenses for International orders, are not included in the final purchase price or shipping cost. Zahir Store has no control over these tax policies that vary by country. Please contact to your local costums office. The costs generated by ruties and customs taxes, will be covered by the Costumer.
COMPLAINTS/ WRONG PRODUCT
To make a complaint CUSTOMERS can contact Zahir Store through the Contact section of the website, or send and e-mail to firstname.lastname@example.org. If a CUSTOMER complaint is found to be justified after checking an item, Zahir Store will either notify the CUSTOMER of the item’s repair, the cost of which shall be borne by Zahir Store, or the item’s replacement for one that is identical if repair is not possible, or if the item is out of stock send you a voucher, within the established terms by the Spanish current legislation. Any defects, scratches and/or stains on the item caused by carelessness, misuse or mishandling, or wear caused by normal use shall not be considered as justified complaints.
If you receive an erroneous order or a defective product, we ask that you contact us immediately, within 24 hours, at the following e-mail address, indicating the error or defect, along with your personal details: email@example.com
In the event of problems with the packaging, you must notify the courier service as soon as you receive the order.
CONFIDENTIALITY The personal details received at Zahir Store are confidencial and we pledge not to communicate them to any third party.
The user has the option of preventing the creation of cookies by selecting the appropriate option in their browser program. However, Zahir Store is not responsible for the disabling of cookies impairing the smooth functioning of the website.
EVENTS BEYOND OUR CONTROL
We shall not be held liable for any non-compliance or delay in compliance of any of the obligations assumed in a Contract, when the cause is due to events that are beyond our reasonable control (“Force Majeure”).
Force Majeure includes any act, event, lack of service, omission or accident that is beyond our reasonable control, especially including but not limited to the following:
– Strikes, lock-outs or other protest measures. – Civil unrest, revolt, invasion, terrorist attack or terrorist threat, war (whether declared or not) or threat or preparation for war. – Fire, explosion, storm, flooding, earthquake, sinking, epidemic or any other natural disaster. – Inability to use trains, ships, aircraft, motor transport or other means of transport, whether public or private. – Inability to use public or private telecommunication systems. – Acts, decrees, legislation, regulations or restrictions by other governments.
Our obligation to fulfil any Contract shall be understood to be suspended during the period in which the Force Majeure situation remains in effect, and we shall be granted an extension in the period of time stipulated to fulfil our obligation while such a situation lasts. We will make every effort to bring an end to the Force Majeure situation or to find a solution by any means that enable us to fulfil our obligations under the Contract, despite the situation of Force Majeure.
RIGHT OF WITHDRAWAL
The products are packaged so as to respect the standards of transport in force, and to ensure an optimal protection of the products during their delivery. It is requested from the Customer to respect these same standards in the case of a product being returned because of after-sales service or for reasons of suitability. Any damage noted to a product arising from the product not being repackaged properly may lead to an only partial refund, or no refund in the event of the impossibility of resale in its state or in the event of a technical problem indicated having been worsened.
RESPONSIBILITY OF THE CUSTOMER TO CHECK PARCELS UPON RECEPTION
Zahir reminds customers that it is the responsibility of the Customer to inspect his parcels upon reception in the presence of the deliveryman and to notify the transporter as well as Zahir company of any anomaly (bumps, damage to the parcel, …) within two working days. In the case where such elements are not noted on the delivery slip presented to the Customer by the transporter, no complaint related to the state of the parcel can be accepted a posteriori by Zahir.
In order to ensure the satisfaction of its Customers, Smallable accepts the return by post to the address indicated by the Customer Service or the delivery note of the relevant Article, for a period longer than the legal withdrawal period referred to above. As such, the Customer has fourteen (14) days from the date of receipt of the order to retract and return the Items. The return of Items beyond this period will not be accepted.

Zahir suggests to Customers to return their products by registered mail or with a complementary insurance, guaranteeing them, if necessary, the compensation of the products to the level of their real market value in case of spoliation or loss of this commodity. In all cases, the return is made at the risk of the Customer. It will be up to the customer to keep any proof of return. The return costs are the responsibility of the customer, who is free to choose the shipping method.

If the Customer fails to meet the deadlines, Smallable will not refund the Customer.
Only Items returned in their original packaging in perfect condition for resale (shoe box, laminated pouches...) will be accepted. As a result, returned clothes washed and/or worn, as well as damaged boxes will be refused.
Retraction can never be exercised if the items delivered are items that have been, even partially, washed, soiled, damaged or used. Similarly, the Items returned incomplete, damaged or soiled by the Customer will not be returned nor exchanged.
The Items must also be provided with the purchase order, either on the return voucher, attached to the delivered Items signed by the Customer, or on any other document. The Customer is informed that the use of the return voucher facilitates the return procedure by Smallable. The Customer is therefore strongly encouraged to use this return voucher.
The Customer’s liability may only be incurred in the event of depreciation of the Item resulting from manipulations other than those necessary to establish the nature, characteristics and, as the case may be, the proper functioning of the Items.
Refund in case of use of the right of withdrawal will be made by the same means of payment as used by the Customer for the initial transaction
TERRITORIALITY AND APPLICATION LAW
The sale of products of Zahir company are subject to Spanish law. Any dispute relating to the existence, interpretation, execution or breach of the contract concluded between Zahir and the Customer, even in the event of a plurality of defendants, will be, in the absence of mutual agreement, the exclusive competence of the tribunals of Cádiz
These Terms and Conditions of Sale constitute the entire agreement between the parties concerned. In the event that one of the clauses of these Terms and Conditions is null and void, this shall not affect the remaining terms and conditions.
